1. Worum es geht
This privacy policy explains which personal data we process when you visit our website, send an enquiry or booking, contact us or place an order – and what rights you have.
The Swiss Federal Act on Data Protection (DSG, SR 235.1) with the Data Protection Ordinance (DSV) is decisive. Where the EU General Data Protection Regulation (DSGVO) applies in an individual case, we also observe it.
2. Welche Daten wir bearbeiten und wozu
Besuch der Website
When you access our website, the server automatically stores technical information in log files (server logfiles):
- IP address of the accessing device
- Date and time of access
- Address accessed (URL) and referrer URL
- Browser type, browser version and operating system
We need this data for the secure and stable operation of the website and to prevent misuse. It is not merged with other data and is generally deleted after 14 days.
Cookies und lokaler Speicher
We use only technically necessary cookies: for the customer account (login, “stay logged in” on request) and for the website chat (so that an ongoing conversation is preserved). In your browser's local storage we remember individual settings, such as light or dark mode or whether you have closed the greeting in the chat. We do not use advertising or analytics services from third parties and do not create usage profiles. Fonts and images are loaded from our own server; no data is transmitted to third parties such as Google. Exception: the map on the contact page (Google Maps) and any availability calendar (Microsoft Outlook) are only loaded once you click on them; only then does the respective provider receive your IP address and technical information about your browser.
Anonyme Besucherstatistik
To improve our website, we count page views on our own server – without cookies and without third-party services. We store the page viewed, the referring page (e.g. a search engine), the device type (mobile, tablet, computer), the browser language and whether a booking was opened or completed. We do not store your IP address: we derive only a daily identifier from it, which changes every day, so that you cannot be recognised across several days. Whether you have visited the website before is remembered by your browser in its local storage without an identifier. We delete the statistics data after 13 months at the latest.
Terminanfrage und Buchung
When you request an appointment via the website, we process the information you enter: name, company, e-mail, telephone, address of the property, details of the property, preferred appointment, selected services and your remarks. We use this data to answer your enquiry, arrange the appointment, carry out the order and invoice it. The appointment is entered in our business calendar; we send you confirmation, rescheduling and cancellation by e-mail with a calendar file. When you book, we also store the time at which you confirmed the AGB and the privacy policy.
Kundenkonto und Bilder abholen
You can use a customer account to collect your images and to see an overview of your orders. For this we process name, e-mail and, where applicable, company, telephone and billing address. Login is by a one-time code sent by e-mail or by a password, which we store only in encrypted form (as a hash). So that we can issue the invoice at the right time and answer questions about delivery, we record when images were made available, viewed and downloaded. Your images are stored on our own storage in Switzerland.
Kontakt per Formular, Chat, E-Mail oder Telefon
When you contact us, we process your details (e.g. name, e-mail, telephone number, content of the message) in order to answer your enquiry. We operate the website chat with the Chatwoot software on our own server in Switzerland; your chat messages are not sent to the manufacturer or other third parties. So that an ongoing conversation is preserved on your next page view, the chat stores an identifier in a cookie or in your browser's local storage.
Auftragsabwicklung und Buchhaltung
For quotations, orders, invoices and payments, we process contact and billing data in our accounting software bexio (bexio AG, Switzerland). We retain business records for the statutory period of 10 years (Art. 958f OR).
Fotoaufnahmen
Our assignments produce images of buildings, rooms, objects and, where applicable, people. We photograph people only within the scope of the assignment; under our AGB, the client is responsible for the consent of the people depicted. We use images as references (e.g. on this website or on social media) only in accordance with our AGB or with the client's consent.
3. Einsatz von künstlicher Intelligenz (KI)
We use AI-assisted tools, in particular for image editing and retouching, digital home staging and renderings, as well as to support the drafting of texts and the handling of enquiries.
- We enter personal data into AI tools only to the extent necessary for the respective purpose.
- Where the provider allows it, we select settings that exclude the use of your data for training the AI.
- Results from AI tools are checked by us; no automated individual decisions within the meaning of Art. 21 DSG take place.
- Image content altered or generated with AI (e.g. virtual furnishing) is labelled as such on request. The client is responsible for labelling upon publication, for example in real estate listings, insofar as this is required by law or contract.
4. Empfänger und Auftragsbearbeiter
We pass on personal data only to the extent necessary for the stated purposes, required by law or where you have consented. We do not sell data. The following service providers process data on our behalf:
- Website hosting: Hostinger International Ltd., servers in France (EU)
- Accounting, quotations and invoices: bexio AG, Switzerland
- E-mail and calendar: own mail server in Switzerland; sending and receiving are routed via our server at Hostinger (France, EU)
- AI tools in accordance with section 3
Data may also be processed in EU or EEA states; in the assessment of the Federal Council, these ensure adequate data protection. Where processing takes place in the USA, it is carried out by providers certified under the Swiss-U.S. Data Privacy Framework or on the basis of standard contractual clauses recognised by Switzerland (Art. 16 DSG).
5. Aufbewahrung
We process personal data only for as long as necessary for the purpose. Enquiries that do not lead to an order are deleted by us no later than 12 months after they have been dealt with. Data from orders is retained for the statutory retention periods.
6. Datensicherheit
We protect your data with appropriate technical and organisational measures (Art. 8 DSG). The connection to our website is encrypted throughout (HTTPS/TLS), and access to enquiries and orders is restricted to the persons responsible for them.
7. Ihre Rechte
Within the scope of applicable data protection law, you have the following rights in particular:
- Information on whether and which personal data we process about you (Art. 25 DSG)
- Release or transfer of your data in a common electronic format (Art. 28 DSG)
- Rectification of inaccurate data (Art. 32 DSG)
- Deletion of your data or restriction of processing, insofar as no retention obligation prevents this
- Objection to processing and withdrawal of consent given, with effect for the future
To exercise your rights, an e-mail to info@art-on-tour.ch is sufficient. We may require proof of identity. You also have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch; within the scope of the DSGVO, with the competent supervisory authority in the EU.
8. Änderungen
We will amend this privacy policy if our data processing or the legal situation changes. The version published on this website at the relevant time applies.
